These general terms and conditions of sale govern the contractual relationship between nordways.fr and its customers. By ordering from nordways.fr, you acknowledge that you agree to be bound by these conditions which define the terms and conditions for ordering, payment, delivery and the management of any product returns.
Product prices are indicated exclusive of VAT and are those applicable when the order is confirmed by the customer. Delivery charges are invoiced in addition and are indicated before the final confirmation of the order.
For deliveries outside mainland France, the customer undertakes to pay all taxes due on the import of products, customs duty, value added tax and any other taxes due under the laws of the country in which the order is received.
The items on sale comply with current French legislation and the standards applicable in France. The photographs, texts, graphics, information and characteristics illustrating the articles presented are not contractual.
Consequently, nordways.fr cannot be held liable in the event of an error or omission in one of these photographs, texts or graphics, information or characteristics of the articles or in the event of modification of these characteristics by the suppliers.
An acknowledgement of receipt confirming that your order has been processed will be automatically sent to you by e-mail. In certain cases, notably non-payment, incorrect address or other problems with the user's account, nordways.fr reserves the right to block your order until the problem has been resolved.
All the information you provide when placing an order is therefore deemed to be binding on you; Nordways.fr can therefore not be held liable for any consequences resulting from errors in the details of the recipient or the debtor of the order, such as delays and/or errors in delivery. In this context, all costs incurred for the return of the order will be entirely at the purchaser's expense.
Any order implies acceptance of the prices and descriptions of the items available for sale. Nordways.fr undertakes to honour orders received on the website only while stocks last.
We accept payment by credit card: Carte Bleue, Visa, Mastercard.
Nordways.fr uses the Stripe payment module (https://stripe.com/fr). For payments with a European credit card, your banking information (credit card number and validity date) is encrypted by the 3DS system and then processed by our financial partner.
Orders are payable in cash on the day the order is placed. Any confirmed order is considered effective when the authorised bank payment centres have issued approval thereof.
The order will not be dispatched until full payment has been received.
Once the transaction has been completed, an order confirmation e-mail will be sent to you.
The purchaser guarantees nordways.fr that he/she has the necessary authorisation to use the method of payment that he/she chooses when confirming the order form.
Nordways.fr reserves the right to suspend any order or delivery in the event of refusal to authorise payment by financial organisations. The purchaser is advised that nordways.fr cannot be held liable for any misappropriation or fraudulent use of any means of payment.
The usual delivery time is 1 to 2 working days from receipt of payment for items in stock.
The delivery conditions and times will be chosen from the delivery services offered when the order is confirmed.
Delivery times are given for information only. Nordways.fr cannot be held liable for any delay in delivery caused by the carrier.
If products are sold out or unavailable, they will be refunded.
When you receive the goods, you must check their condition, packaging and quantities before signing the delivery note(s). In the event of damage or shortages, make a note of your reservations on the carrier's delivery note(s) and let us know by e-mail no later than 72 hours after receipt of the goods.
This e-mail notification will enable us to take any necessary action against the carrier and, if necessary, to compensate you for any loss suffered. In the absence of any notification within 72 hours, the products are deemed to have been delivered in good condition and in the quantities ordered.

In accordance with the provisions of article L.121-21 of the French Consumer Code, non-professional customers have a period of 14 days from the day following receipt of their order to return any item that does not meet their expectations.
The right of withdrawal does not apply to customised products.
For all return requests, please log into your customer space to access the form.
An acknowledgement of receipt of the withdrawal request will be sent to you by e-mail. This form must be enclosed with the returned goods.
The item must be returned intact in its original packaging, accompanied by all related documents (instructions, guarantee, etc.). If you exercise your right of withdrawal, nordways.fr will reimburse you for the item(s) returned or exchange the item(s).
If a refund is requested, it will be made by crediting the credit card used for payment, within a maximum of 14 days of receipt of the return.
Any right of retraction exercised at the end of the 14 days allowed will be refused by nordways.fr, and the items will be considered as accepted by the purchaser.
All returns must be notified in advance to the Customer Services Department of nordways.fr. If the above procedures are not respected, no claim will be accepted.
For non-professional customers:
In accordance with Articles L.217-4 to L.217-14 of the French Consumer Code, nordways.fr guarantees the Customer against any non-conformity which appears within two years of delivery of the goods sold and which existed on the date of delivery. A non-conformity is defined as any defect which renders the goods unfit for the use normally expected of similar goods, and in particular a non-conformity with the description given by nordways.fr or a lack of quality which the Customer was legitimately entitled to expect with regard to the declarations made by nordways.fr. A non-conformity also includes the fact that the goods sold do not have the characteristics defined by mutual agreement between the Customer and nordways.fr, or their inability to satisfy a specific use stated by the Customer and accepted by nordways.fr. A non-conformity which appears within 24 months of delivery if the goods sold are new, or within 6 months of delivery if the goods sold are second-hand, is presumed to exist on the date of delivery. The Customer may choose between repair and replacement of the goods sold, unless this choice would entail a manifestly disproportionate cost, in which case nordways.fr may proceed according to the method not chosen by the Customer. By way of derogation, the Customer may either return the goods and obtain a refund of the price and costs associated with the sale, or keep the goods and obtain a refund of part of the sale price in the following cases: repair and replacement impossible, solution chosen by the Customer impossible within one month, solution chosen by the Customer involving a major inconvenience given the nature of the goods and their intended use. Defects of which the Customer was aware or could not have been unaware and defects originating in a material supplied by the Customer are excluded from the guarantee.
The personal information and data concerning you is required for the management of your order and our business relationship. It may be passed on to companies that contribute to these relations, such as those responsible for carrying out services and orders, for the management, execution, processing and payment thereof. This information and data is also kept for security purposes, to comply with legal and regulatory obligations and to enable us to improve and personalise the services we offer you and the information we send you.
In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, rectify and object to any personal data concerning you. All you have to do is send us a letter to: NORD'WAYS Customer Services, 166 Avenue de Auréats, 26000 VALENCE.
To enable us to respond quickly, please give us your surname, first name, e-mail address, address and, if possible, your customer reference number, and specify the address to which you would like the reply to be sent.
We may carry out identity checks in order to guarantee the confidentiality and security of your data. In certain cases, you may be asked to provide a copy of an identity document bearing your signature. A reply will be sent to you within 1 month of receipt of the request.
Our website is also designed to be particularly attentive to our customers' needs. This is one of the reasons why we use cookies. The purpose of a cookie is to indicate that you have visited our website. Cookies are therefore only used by nordways.fr to improve our personalised service to you.
This contract is governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
